Direct answer
Section 21 ordinarily requires use of the available service-law remedies. A final rejection by the competent authority, or the statutory situation where a representation remains undecided for six months, matters to the maintainability examination before the AFT.
Legal position and important distinctions
Not every portal complaint constitutes a statutory appeal. Use the correct pension appeal, statutory complaint or service-specific petition before the competent authority and within its prescribed time. Keep delivery evidence. Exhaustion and Tribunal limitation are separate questions: six months of administrative silence is not permission to wait indefinitely. Exceptional urgent judicial relief needs case-specific consideration where irreversible harm is imminent. ER 2023 administrative time-bar provisions and judicial condonation under Section 22(2) are distinct. Examine departmental sanction or time-bar issues independently from the Tribunal’s sufficient-cause enquiry and applicable arrears precedent.
Keep the case file readable
Use a chronology of the main decision, communication, representation, departmental appeal and response. Separate facts from legal submissions. Keep annexures legible and pagination accurate, and disclose earlier or pending proceedings. A large document bundle cannot cure missing grounds or an unclear prayer.
Track what follows submission
Monitor the diary acknowledgement, scrutiny objections, compliance deadline, registration and service. Check the latest cause list or order for hearing and video-appearance arrangements. Maintain current contact details and a written record of registry directions. A filing receipt does not itself establish a stay, admission or success.
Recognise time-sensitive situations
A final adverse decision, impending discharge, custody, payment stoppage or appellate deadline can require prompt advice. Explain the particular grounds and urgent harm for interim relief. General website guidance does not alter an individual statutory time limit.
Practical steps
- Identify the prescribed remedy and competent authority.
- Submit grounds, evidence and relief with delivery proof.
- Examine timely AFT relief after a final decision or the relevant statutory silence.
Documents to collect
- Statutory or pension appeal
- Postal or online acknowledgement
- Rejection or pending status
Hypothetical illustration
The grievance never reaches the competent pension-appeal authority. A portal ticket alone may leave exhaustion contested.
Avoid this mistake
Calling a representation an appeal does not cure filing it before an incompetent authority.
