Direct answer
Parental eligibility depends on pension category, dependency and the presence of other eligible family members. Ordinary family pension and casualty or dependent benefits can have different priorities and conditions.
Legal position and important distinctions
Being a nominated parent does not establish every monthly pension entitlement. Examine dependency at the relevant time, income, eligible spouse or children and the governing hierarchy. Ex gratia, insurance, gratuity and family pension are separate benefits; payment of one does not prove entitlement to another. A rejection citing a spouse should still be examined against the correct category and any distinct parental benefit.
Identify the beneficiary and the benefit
Family pension, gratuity, insurance, ex gratia and accrued arrears are distinct rights. A nomination may concern one benefit and is not the answer for all. Read the eligible-family hierarchy, dependency and continuing conditions for ordinary, special and liberalised categories separately. Compare Army examples with the current rules of the relevant service.
Make the family record clear
Prepare a chronology of the relevant death or disappearance, relationship, marriage or divorce, disability and income facts. Disclose competing claimants rather than concealing their status. Include the relevant PPO endorsement, objection and supporting certificates. A credit into a family bank account is not a substitute for legal sanction.
Seek workable relief
First seek a reasoned determination of the correct category and eligible claimant; then address commencement, payment and arrears. Changing a beneficiary, setting aside rejection and recovering earlier payments are separate issues. A private status dispute may also require the appropriate civil or family forum.
Practical steps
- Confirm casualty and pension categories.
- Document dependency, income and other family members.
- Seek a benefit-specific sanction decision under the relevant rules.
Documents to collect
- Relationship and death records
- Income or dependency proof
- Family details, nomination and PPO
Hypothetical illustration
The mother is the insurance nominee while an eligible spouse survives for family pension. The claimant rules for the two benefits must be read separately.
Avoid this mistake
Do not equate a lump-sum assistance payment with service family pension or inheritance.
