There is no universal rule in India requiring a wife to receive half of her husband’s property or salary in every divorce. Maintenance, alimony, ownership and residence are separate legal questions.

Sections 24–25 of the Hindu Marriage Act concern financial relief based on income, property and the circumstances of the case. Joint ownership, stridhan (a woman’s property) or other rights may have a separate basis. An amount awarded in a widely discussed case should not be treated as a fixed formula for all marriages. Applicable local laws and the nature of the property may also affect the outcome.

What should you do now?

  1. Separate the documents showing the actual owners of the assets and any joint contributions.
  2. Prepare a list of monthly expenses, income and dependants.
  3. Understand the terms of a lump-sum settlement or regular payments, and how compliance will be ensured.

Which documents should you keep?

Income records, property documents, details of loans, children’s expenses and settlement proposals.

Avoid this mistake

It is wrong to treat figures such as 25%, 33% or 50% mentioned on social media as mandatory rules of law.

A hypothetical example

Two families have different incomes, dependants and assets. It would be wrong to describe a settlement in the first case as a mandatory 50% formula in the second. Ownership and financial relief must be assessed separately in each case.

Can spouses agree on an amount by mutual consent?

Yes, a lawful settlement is possible; the court process, the interests of the children and other applicable rights will be considered.
