An 11-month agreement is not a mandatory term throughout India. The practice is linked to custom and the central registration threshold for certain leases, but special state rules may differ.
The Registration Act contains provisions requiring registration of year-to-year leases, leases for a term exceeding one year, and leases reserving yearly rent. This does not mean that every 11-month agreement is exempt from registration in all states. Stamp duty, tenancy law, and the leave-and-license rules in some states must also be considered.
What should you do?
- Decide the actual tenancy term, renewal terms, and notice period.
- Check the registration and stamp duty requirements applicable in the state.
- Clearly set out the terms for rent, deposit, repairs, and handover.
Which documents should you keep?
Identification documents of the landlord and tenant, property details, the agreement, and payment records.
Do not make this mistake
Do not assume that making a new document every 11 months will always place the tenancy outside rent control or other laws.
A hypothetical example
An 11-month form was downloaded from the internet, but the property is in a state with special registration rules. Rather than assuming there is an exemption based on the template’s term, check state law and the document’s actual terms.
Is a 12-month agreement illegal?
No. Registration and other formalities must be completed in accordance with its terms and the applicable law.
