BNSS 479 provides a framework for the release of certain undertrials based on the period of detention. It is important to check conditions such as the offence, maximum punishment, previous convictions and other pending cases.
Understand the law and procedure
The general half-period rule and the provision for eligible first-time offenders after one-third of the period should be read together with their exceptions. Specified categories involving death or life imprisonment, as well as situations involving multiple offences or cases, may affect entitlement. The question of calculating delays caused by the accused may also be relevant. The mere fact that a case has been pending for a long time is not, by itself, sufficient grounds for every benefit under this section. Jail authorities and legal services institutions may play an important role in identifying eligibility for release. Regular bail may still be considered as a separate remedy, depending on the facts.
In detail: What factors may change the outcome?
Families should not apply based only on details of one FIR if the person is also detained in other cases. Obtain custody warrants and case-wise status information. The maximum punishment and actual period of custody must be calculated accurately; do not calculate on the basis of an assumed possible sentence. If an eligible person faces practical difficulties with a bond or surety, seek assistance from legal aid.
What should you do?
- Prepare a list of every pending case, conviction history and period of custody.
- Have eligibility under the specific section checked by the jail legal-aid clinic or the DLSA.
- Complete the process for filing an appropriate application before the relevant court and meeting the necessary release conditions.
Which documents should you keep?
Keep the custody certificate, FIRs, charge details, case status and records of previous convictions.
Hypothetical example
An undertrial was imprisoned for the first time, but two separate cases were pending against him. It would not be correct to assume that release after one-third of the period is guaranteed merely because of his first-time status; the exceptions under the section must also be reviewed.
If relief is not available under this section, can regular bail still be sought?
That is not the case. Statutory release of an undertrial and other bail remedies may be considered on separate grounds.
