Direct answer
Check the operative directions, compliance period and any appellate stay. After service and expiry of the required period, examine appropriate implementation or execution proceedings and any available contempt remedy.
Legal position and important distinctions
Section 29 concerns execution and Section 19 addresses contempt powers. Delay alone does not automatically justify punishment of every officer; the clear direction and requirements such as wilful non-compliance need examination. An appeal being filed differs from an actual stay. A reconsideration direction is not necessarily an order to pay a fixed sum. Document partial compliance through a due-versus-paid calculation.
Choose the next proceeding from the actual decision
Read the signed order and determine whether it grants relief, directs reconsideration, dismisses a claim, gives interim directions or decides contempt. That distinction guides implementation, review, writ or statutory appeal. The heading or case-status entry alone may mislead. Preserve earlier pleadings and the material record.
Record separate dates and directions
Distinguish decision, copy receipt, communication, compliance deadline, leave request and refusal dates. Different remedies have different clocks. Obtain an actual judicial order for any claimed stay. Disclose previous challenges and pending proceedings: parallel proceedings seeking the same relief can raise maintainability issues.
Distinguish changing an order from enforcing it
Use the competent forum with the right relief, limitation explanation and respondents. Mere disagreement does not establish review or constitutional-interference grounds. Explain the admissibility of any new facts and why they were not previously presented.
Practical steps
- Preserve the signed or certified order and service proof.
- Confirm the compliance deadline and stay status.
- Identify the unperformed direction and calculation in the appropriate application.
Documents to collect
- AFT order and delivery proof
- Stay or appeal status
- Compliance correspondence and due-versus-paid statement
Hypothetical illustration
Pension is revised but ordered arrears remain unpaid. Identify those arrears and the corresponding operative direction.
Avoid this mistake
Execution should not be used to introduce substantive relief outside the original order.
