Direct answer
Unauthorised absence and desertion are distinct allegations; duration alone should not collapse them into one. The service statute, events, intention where relevant and actual proceedings determine the defence and remedy.
Legal position and important distinctions
Leave sanction, extension requests, medical emergencies, communications and efforts to return are important evidence. A serious charge is not resolved merely by a family explanation. Inquiry, administrative discharge and court-martial conviction are different stages. Establish the current status and authority, then obtain advice on lawful reporting, custody or bail. False medical papers or backdated leave requests can seriously worsen matters.
Examine the legal basis of the order
Identify the authority, power, policy period and prescribed procedure. An adverse outcome alone does not prove illegality. Show a specific error, ignored relevant record, unequal treatment or a denied required opportunity. Present the military-discipline and administrative-discretion context fairly.
Prepare the representation and relief
Number the notice, reply, decision and service records as annexures. Use the prescribed service remedy before the competent authority. Consequential pay or pension and alternative fresh-consideration relief may require distinct prayers. Explain the complete chronology if late; a continuing financial effect does not reopen every historical service decision.
Read interim directions accurately
A representation or filing does not automatically stay the order. Read the operative language, duration and conditions of an actual stay. A direction for reconsideration requires a lawful fresh decision; it does not itself guarantee promotion, reinstatement or sanction of every claimed sum.
Practical steps
- Obtain the unit record and charges or status.
- Organise the actual absence timeline and supporting evidence.
- Use the appropriate statutory defence or appeal and necessary custody remedy.
Documents to collect
- Leave and communications
- Medical or emergency evidence
- Inquiry, charges and discharge or conviction records
Hypothetical illustration
Hospital admission and communication to the unit are documented. Establish the timeline through original evidence without assuming absence is automatically excused.
Avoid this mistake
An AFT application does not authorise continued absence or avoidance of lawful process.
