Understanding law and procedure

Direct answer

Broad banding uses a prescribed higher band to calculate an eligible disability benefit. It does not rewrite the actual clinical assessment or automatically award a 50 percent benefit to every member of the armed forces.

Legal position and important distinctions

First establish service connection, entitlement and the governing policy. Then examine the assessed percentage, duration, invalidment or retention category and any earlier capitalised award. The order dated 27 December 2023 distinguishes relevant categories. The 2026 Sgt Girish Kumar judgment is also important for recomputation and arrears of an eligible existing pension; it is not automatic sanction of every fresh claim. The revised calculation bands of 27 December 2023 are: assessment up to 50 maps to 50; more than 50 and up to 75 maps to 75; more than 75 and up to 100 maps to 100. For retained personnel, actual disability must be at least 20 percent and for life. The medical board records actual assessment; the Pension Sanction Authority applies broad banding. Check the effective date and historical policy distinctions.

Separate three decisions

Diagnosis, the assessed impairment percentage and legal entitlement to pension are different enquiries. Identify which board or authority decides each question. A supporting medical certificate is not final pension sanction. Likewise, a low medical category does not necessarily establish permanent incapacity or inability to undertake civil employment.

Prepare an evidence-based appeal

Date enrolment, first diagnosis, treatment, boards, discharge and rejection. Link every disputed finding to a specific annexure and page. Where ER 2023 applies, examine the six-month first and second pension-appeal provisions from the relevant rejection or sanction letter. Administrative time-bar provisions and judicial condonation before the AFT are distinct. An RTI request or reminder should not cause the original deadline to be missed.

Choose the correct relief

Depending on the defect, seek recognition of entitlement, correct classification, fresh medical consideration, a corrigendum PPO or calculation correction. Reassessment and payment sanction are not necessarily the same decision. Explain the arrears period and interest basis separately.

Practical steps

  1. Check the accepted assessment and payment band in the PPO.
  2. Compare the broad-banding instruction applicable to your category.
  3. Prepare a month-wise difference and seek a corrected PPO with arrears.

Documents to collect

  • PPO and corrigenda
  • Medical board and discharge order
  • Record of any earlier lump-sum benefit

Hypothetical illustration

An accepted 20 percent disability element is paid without the calculation band required by the governing policy. The dispute may concern computation rather than initial entitlement.

Avoid this mistake

Claim arrears and interest by reference to the applicable entitlement rather than copying another case’s figures.
