Detailed analysis

Understanding law and procedure

Direct answer

CAPF personnel do not ordinarily fall within AFT jurisdiction merely because they wear a uniform. The AFT Act concerns the specified Army, Navy and Air Force service statutes. The correct forum depends on the force, dispute and governing law.

Legal position and important distinctions

Service under the BSF or CRPF statute is not automatically service under the Army Act. Departmental remedies and, where appropriate, Article 226 proceedings may be relevant. The CAT is not automatically available to every uniformed force either: its own coverage and exclusions must be checked. Deputation or special statutory application requires examination of the actual appointment and orders.

Identify the jurisdictional connection

State separately the law governing the person, the decision challenged and the relief requested. A common payment portal or employment at a military establishment does not place every employee before the same tribunal. Retirement status and the claimant’s own legal interest can also matter.

Check before filing

Collect appointment or enrolment records, the disputed final order, departmental remedies and the location of the relevant events. Read both the positive jurisdiction and express exclusions. Filing in the wrong forum does not necessarily preserve another forum’s limitation period. A similar-looking case or an informal office suggestion is not proof of territorial jurisdiction.

Link the remedy to the actual defect

Identify the error in the notice or decision, the resulting prejudice and the correction sought. Where the matter belongs before a High Court or another forum, its own maintainability and interim-relief requirements apply. An AFT template cannot be used indiscriminately for all proceedings.

Practical steps

  1. Identify the force, appointment and governing Act.
  2. Check departmental appeals and the final order to be challenged.
  3. Confirm the competent forum and territorial jurisdiction before filing.

Documents to collect

  • Appointment and service statute
  • Final order and appeal rules
  • Posting and cause-of-action records

Hypothetical illustration

Filing a CRPF promotion grievance before the AFT merely because the force is described as armed can generate a serious forum objection.

Avoid this mistake

Do not collapse CAPFs, Assam Rifles, Coast Guard and civilian defence posts into one jurisdictional category.
