Understanding law and procedure

Direct answer

A low assessment is not revised merely because the claimant disagrees. Identify an inadequate examination, ignored severity, an incorrect medical guideline or inconsistent findings, and use the available reassessment and appellate process.

Legal position and important distinctions

Diagnosis, functional limitation, permanence and pension entitlement are distinct issues. A private specialist opinion can support a challenge but does not itself replace the authorised military board process. Multiple conditions require the authorised method of composite assessment, not simple addition. A tribunal may examine legality or the need for fresh assessment; it does not routinely substitute its own medical percentage.

Separate three decisions

Diagnosis, the assessed impairment percentage and legal entitlement to pension are different enquiries. Identify which board or authority decides each question. A supporting medical certificate is not final pension sanction. Likewise, a low medical category does not necessarily establish permanent incapacity or inability to undertake civil employment.

Prepare an evidence-based appeal

Date enrolment, first diagnosis, treatment, boards, discharge and rejection. Link every disputed finding to a specific annexure and page. Where ER 2023 applies, examine the six-month first and second pension-appeal provisions from the relevant rejection or sanction letter. Administrative time-bar provisions and judicial condonation before the AFT are distinct. An RTI request or reminder should not cause the original deadline to be missed.

Choose the correct relief

Depending on the defect, seek recognition of entitlement, correct classification, fresh medical consideration, a corrigendum PPO or calculation correction. Reassessment and payment sanction are not necessarily the same decision. Explain the arrears period and interest basis separately.

Practical steps

  1. Collect the investigations, reports and assessment worksheet.
  2. Ask a specialist to explain the precise misapplication of the assessment standard.
  3. Identify that error and the requested reassessment in the appeal.

Documents to collect

  • Board proceedings and clinical tests
  • Relevant GMO standard
  • Specialist opinion and appeal

Hypothetical illustration

The board records restricted mobility but applies a category that assumes no such restriction. That internal inconsistency can support a focused review.

Avoid this mistake

Distinguish later deterioration from an incorrect assessment made on the original board date.
