For a service matter, a Section 14 OA should identify the impugned order, material facts, legal grounds, departmental remedies, limitation and precise relief. A court-martial appeal should not simply be relabelled as an OA.

Understanding law and procedure

Direct answer

For a service matter, a Section 14 OA should identify the impugned order, material facts, legal grounds, departmental remedies, limitation and precise relief. A court-martial appeal should not simply be relabelled as an OA.

Legal position and important distinctions

Prepare an index, chronology, legible annexures, verification or affidavit and vakalatnama where applicable. Keep dates and pagination consistent. Link each challenge to the competent authority’s actual decision. File separate, evidence-supported applications for interim relief or condonation where required. Tracking scrutiny defects, registration and service is as important as the initial submission.

Keep the case file readable

Use a chronology of the main decision, communication, representation, departmental appeal and response. Separate facts from legal submissions. Keep annexures legible and pagination accurate, and disclose earlier or pending proceedings. A large document bundle cannot cure missing grounds or an unclear prayer.

Track what follows submission

Monitor the diary acknowledgement, scrutiny objections, compliance deadline, registration and service. Check the latest cause list or order for hearing and video-appearance arrangements. Maintain current contact details and a written record of registry directions. A filing receipt does not itself establish a stay, admission or success.

Recognise time-sensitive situations

A final adverse decision, impending discharge, custody, payment stoppage or appellate deadline can require prompt advice. Explain the particular grounds and urgent harm for interim relief. General website guidance does not alter an individual statutory time limit.

Practical steps

  1. Confirm the bench and statutory remedy.
  2. Number the annexures, including the decision and exhausted remedies.
  3. Follow the current registry checklist and cure filing defects.

Documents to collect

  • OA, chronology and annexure index
  • Order and service, medical or pension records
  • Appeals, affidavit and authorisation

Hypothetical illustration

A claimant lists an arrears figure without a PPO or rejection order. Adding the underlying record and calculation makes the actual dispute identifiable.

Avoid this mistake

Do not file a generic OA containing invented facts, incomplete dates or incorrect annexure references.
