Detailed analysis

Understanding law and procedure

Direct answer

Impairment relief concerns eligible personnel retained in service despite disability. The 2023 framework distinguishes medical invalidment from retention; the retirement date alone does not determine the applicable rules.

Legal position and important distinctions

The Ministry’s clarification of 6 October 2023 states that deaths and disabilities reported or recorded after 21 September 2023 fall under ER/GMO 2023, while existing compensation recipients are not affected merely by that revision. Examine the RIAB, retention order, capitalised option and conditions governing monthly relief at retirement. Receipt of a capitalised benefit should not be assumed compatible with unrestricted duplicate monthly compensation for the same disability. ER 2023 administrative time-bar provisions and judicial condonation under Section 22(2) are distinct. Examine departmental sanction or time-bar issues independently from the Tribunal’s sufficient-cause enquiry and applicable arrears precedent.

Separate three decisions

Diagnosis, the assessed impairment percentage and legal entitlement to pension are different enquiries. Identify which board or authority decides each question. A supporting medical certificate is not final pension sanction. Likewise, a low medical category does not necessarily establish permanent incapacity or inability to undertake civil employment.

Prepare an evidence-based appeal

Date enrolment, first diagnosis, treatment, boards, discharge and rejection. Link every disputed finding to a specific annexure and page. Where ER 2023 applies, examine the six-month first and second pension-appeal provisions from the relevant rejection or sanction letter. Administrative time-bar provisions and judicial condonation before the AFT are distinct. An RTI request or reminder should not cause the original deadline to be missed.

Choose the correct relief

Depending on the defect, seek recognition of entitlement, correct classification, fresh medical consideration, a corrigendum PPO or calculation correction. Reassessment and payment sanction are not necessarily the same decision. Explain the arrears period and interest basis separately.

Practical steps

  1. Identify when the disability was first recorded.
  2. Check RIAB, retention and benefit-option documents.
  3. Challenge incorrect classification or calculation through a rule-based representation and appeal.

Documents to collect

  • First recorded disability entry
  • RIAB and retention order
  • Option form and payment/PPO

Hypothetical illustration

Two members retire together, but their disabilities were recorded in 2022 and 2024 respectively. The governing rules and benefit categories need separate examination.

Avoid this mistake

Do not claim that the 2023 rules automatically discontinued disability pension for all existing pensioners.
