Direct answer
Obtain the recovery order, calculation, period and legal basis. Fraud, misrepresentation, an undertaking and a purely departmental calculation error involve different considerations; recovery is neither universally valid nor universally prohibited.
Legal position and important distinctions
Use a due-versus-paid chart to identify the revision, months and component involved. Raise hearing requirements, a reasoned decision and hardship under the applicable law. Identification of an overpayment and legal permissibility of recovery are separate questions. Respond to the notice and disclose any undertaking. A request for limited interim protection should show the actual immediate hardship.
Separate sanction, calculation and payment
Reconcile the benefit sanctioned, the rate or table applied and the sum actually credited. Separate basic pension, dearness relief, commutation and recovery in the pension slip. Do not compare a net bank credit with another person’s basic pension. Incorrect service data may require correction beyond the disbursing agency.
Present a reliable financial claim
Prepare a month-wise table of the component due, amount paid, difference and supporting rule or order. Deduct arrears already received to avoid double counting. Identify the period, starting date and legal basis for interest separately. Explain which source record and consequential PPO need correction so that the authority can decide the actual issue.
Move from grievance to the appropriate remedy
Retain official grievance references and written responses. A corrected technical issue may avoid unnecessary proceedings. If entitlement remains disputed, examine departmental remedies, the competent forum and limitation. Describing a claim as monthly pension does not remove every procedural objection.
Practical steps
- Obtain the notice or order and full calculation.
- Respond with supported arithmetic, legal and hardship objections.
- Seek timely departmental and, if necessary, interim or final judicial relief.
Documents to collect
- Recovery order and calculation
- PPO, revision and undertaking
- Bank deductions and hardship evidence
Hypothetical illustration
An incorrect component was paid for several years. Even if the arithmetic is correct, the authority to recover and applicable protections need separate examination.
Avoid this mistake
Do not rely on an absolute assertion that recovery from a retired person is never permissible.
