Detailed analysis

Understanding law and procedure

Direct answer

Under the ordinary framework, restoration of the commuted portion is linked to the prescribed fifteen-year period. Check its starting point, effective reduction, due date and governing instruction; a shorter period circulated on social media is not itself the rule.

Legal position and important distinctions

Retirement, commutation payment and commencement of reduction may occur on different dates. Read the sanction with the governing instruction to determine the due date. Identify the component restored separately from dearness relief or another revision. Pending litigation or interim protection for another claimant does not automatically suspend deductions for all pensioners. Regulation 163 of Army Pension Regulations Part I describes fifteen-year restoration. Commutation notified with retirement or discharge must be distinguished from reduction becoming effective later. Confirm the sanction, effective reduction and official restoration date.

Separate sanction, calculation and payment

Reconcile the benefit sanctioned, the rate or table applied and the sum actually credited. Separate basic pension, dearness relief, commutation and recovery in the pension slip. Do not compare a net bank credit with another person’s basic pension. Incorrect service data may require correction beyond the disbursing agency.

Present a reliable financial claim

Prepare a month-wise table of the component due, amount paid, difference and supporting rule or order. Deduct arrears already received to avoid double counting. Identify the period, starting date and legal basis for interest separately. Explain which source record and consequential PPO need correction so that the authority can decide the actual issue.

Move from grievance to the appropriate remedy

Retain official grievance references and written responses. A corrected technical issue may avoid unnecessary proceedings. If entitlement remains disputed, examine departmental remedies, the competent forum and limitation. Describing a claim as monthly pension does not remove every procedural objection.

Practical steps

  1. Check the commutation sanction and commencement of reduction.
  2. Obtain the rule-based restoration-date calculation.
  3. After the due date, seek PPO or payment correction and resulting arrears.

Documents to collect

  • Commutation sanction and PPO
  • Payment and reduction commencement records
  • Restoration request and pension slips

Hypothetical illustration

Retirement predates commutation and pension reduction. The retirement anniversary alone may not determine the restoration date.

Avoid this mistake

Do not assume a viral claim about 108 or 120 months automatically changes your applicable restoration period.
