Direct answer
The Act covers persons subject to the relevant service statutes and, for their service matters, retired personnel and specified dependants, heirs and successors. A family claimant must establish their legal interest in the particular service benefit.
Legal position and important distinctions
A widow’s family-pension claim, an heir’s claim for unpaid retirement dues and a member’s promotion dispute involve different legal interests. Relationship alone does not confer every benefit; apply the specific succession and dependency rules. If the deceased already had pending proceedings, examine substitution of legal representatives rather than filing an identical fresh case.
Identify the jurisdictional connection
State separately the law governing the person, the decision challenged and the relief requested. A common payment portal or employment at a military establishment does not place every employee before the same tribunal. Retirement status and the claimant’s own legal interest can also matter.
Check before filing
Collect appointment or enrolment records, the disputed final order, departmental remedies and the location of the relevant events. Read both the positive jurisdiction and express exclusions. Filing in the wrong forum does not necessarily preserve another forum’s limitation period. A similar-looking case or an informal office suggestion is not proof of territorial jurisdiction.
Link the remedy to the actual defect
Identify the error in the notice or decision, the resulting prejudice and the correction sought. Where the matter belongs before a High Court or another forum, its own maintainability and interim-relief requirements apply. An AFT template cannot be used indiscriminately for all proceedings.
Practical steps
- Identify service status and your legal interest in the benefit.
- Document relationship, death and dependency where required.
- Check substitution and its time limit if proceedings are already pending.
Documents to collect
- Service number and PPO
- Death and relationship records
- Dependency or legal-representation documents
Hypothetical illustration
A veteran dies during pension litigation. The spouse’s own family-pension entitlement and succession to the veteran’s accrued arrears should be distinguished.
Avoid this mistake
Do not assume that all heirs have an equal right to receive monthly family pension.
