Direct answer
Women officers are entitled to fair consideration under the applicable policy and binding decisions. Automatic permanent commission or identical consequential relief should not be assumed for every branch, entry scheme or batch.
Legal position and important distinctions
Secretary, Ministry of Defence v. Babita Puniya, decided on 17 February 2020, is important for permanent commission of women SSC officers in the Army. Read its operative directions alongside subsequent implementation and service-specific criteria. Medical standards, assessment, service length and earlier consideration can matter. A claim to non-discriminatory consideration differs from a direct demand for appointment or pension sanction.
Examine the legal basis of the order
Identify the authority, power, policy period and prescribed procedure. An adverse outcome alone does not prove illegality. Show a specific error, ignored relevant record, unequal treatment or a denied required opportunity. Present the military-discipline and administrative-discretion context fairly.
Prepare the representation and relief
Number the notice, reply, decision and service records as annexures. Use the prescribed service remedy before the competent authority. Consequential pay or pension and alternative fresh-consideration relief may require distinct prayers. Explain the complete chronology if late; a continuing financial effect does not reopen every historical service decision.
Read interim directions accurately
A representation or filing does not automatically stay the order. Read the operative language, duration and conditions of an actual stay. A direction for reconsideration requires a lawful fresh decision; it does not itself guarantee promotion, reinstatement or sanction of every claimed sum.
Practical steps
- Identify the service, branch, entry and batch policy.
- Obtain the consideration record and refusal reasons.
- Show the specific inconsistency with the governing judgment or policy and identify consequential relief.
Documents to collect
- Commission and extension papers
- PC policy and board outcome
- Medical, assessment and representation records
Hypothetical illustration
An officer is assessed using criteria inconsistent with the applicable batch policy. Identify that difference and the relevant judicial directions.
Avoid this mistake
Do not apply one Army judgment indiscriminately to every Navy or Air Force entry.
