The restriction concerns this statutory route
BNSS section 479(2) restricts the relevant release where investigation, inquiry or trial in more than one offence or multiple cases is pending, subject to the third proviso. Saying that only one FIR exists does not necessarily answer the separate multiple-offence wording. Examine the complete language, actual pendency and applicable interpretation rather than reducing the issue to the number of FIR documents. [1]
This does not mean that no bail can ever be sought under any provision. Section 479's specific entitlement differs from ordinary regular bail or an appropriate constitutional remedy. Bail in one prosecution also does not end a valid detention order in another. Prepare a separate status and custody list for every proceeding.
Distinguish pending from concluded proceedings
Supply authorised orders of acquittal, closure, quashing or final disposal. A historical reference to an FIR is not necessarily a currently pending prosecution, but the accused's assertion alone cannot establish closure either. Verify the present investigation or trial status through the relevant record. Incorrect disclosure can distort the eligibility assessment.
For example, where one of three proceedings has ended and two remain pending, record each status and custody position separately. Consider the statutory maximum-detention safeguard in its proper setting as well.
This issue cannot be resolved by a calculator alone. Counsel should assess every offence, proceeding and independent bail ground before framing the request, without treating failure of section 479 eligibility as a universal bar to all release remedies.
Identify which proceedings remain pending through current orders. A historical FIR reference and an operative custody order do not establish the same legal fact.
Frame the prolonged-custody argument accurately
Consider the custody period alongside the maximum punishment, accusations and remaining trial. Statutory eligibility under BNSS section 479 differs from the constitutional question of an effective speedy trial under Article 21. Failure of one route does not necessarily extinguish every other statutory or constitutional remedy. [1] [2]
Explain how attendance and witness safety can be secured after release. Support an assertion of an uncertain trial with the available orders. Counting another accused's months in custody cannot determine the outcome of this application. Each ground requires its own legal assessment, including the effect of any applicable special enactment.
Build a reliable case chronology
Keep the FIR, arrest and first remand dates, prison details, alleged sections and earlier orders together. Prepare a short chronology distinguishing allegations, prosecution assertions and facts supported by records. An incorrect date or incomplete crime number can obstruct an otherwise urgent request.
Tell counsel about previous cases, earlier bail applications and outstanding warrants. Preserve original digital files and available acknowledgments. Annex documents that explain the relevant issue rather than collecting unrelated private information. After each hearing, record the next date and the directions actually made. A clear file helps counsel identify both the appropriate remedy and the material the court still needs.
Check what is required for actual release
Grant of bail and departure from prison can be separated by execution of bonds, acceptance of sureties and transmission of the release order. Verify the accused's identifying details, crime number and prison. Correct errors through the proper process rather than informally altering a document. [1]
A valid detention order in another matter can prevent complete release despite bail in one case. Ask counsel or an authorised relative to check every pending custody status. Avoid paying an unknown intermediary promising immediate release. Identify the precise administrative or judicial obstacle, obtain the relevant information and approach the responsible court or prison authority.
Present grounds that address the actual case
Connect the accused's individual role, available evidence, investigation stage, custody period and trial progress. Merely labelling the FIR false does not explain why release is justified. When relying on a document, show how it affects identification, recovery, the allegation or the continuing need for custody.
A bail hearing does not finally determine the entire prosecution. Nevertheless, serious allegations, applicable special legislation, antecedents and witness safety remain relevant. Prepare an answer to adverse material as well as highlighting favourable facts. Relief granted to another accused does not guarantee the same outcome without a proper comparison of roles and circumstances. [3]
