Received a Demolition Notice? Understanding the Supreme Court’s Safeguards

Notice, a hearing and a reasoned decision are important safeguards in demolition proceedings. The Supreme Court’s directions provide for a general procedure as well as specific exceptions, so the same protection should not be assumed to apply to every structure.

Notice, a hearing and a reasoned decision are important safeguards in demolition proceedings. The Supreme Court’s directions provide for a general procedure as well as specific exceptions, so the same protection should not be assumed to apply to every structure.

Understand the Law and Procedure

A 2024 judgment set out safeguards for general cases, including a notice framework that allows the period prescribed by local law or at least fifteen days, whichever is longer. It is also necessary to consider the specified exceptions, including public places, roads, footpaths, areas adjacent to railway lines, water bodies and demolitions ordered by a court. A notice does not, by itself, constitute a final demolition order. The allegation of unauthorised construction and the actual sanctioned position will be examined separately. The question of demolishing property solely on the basis of a criminal accusation is also significant in the judgment. Do not treat any protection as a guarantee that illegal construction will be regularised.

In Detail: What Could Affect the Outcome?

Record the actual date and mode of service of the notice. Clarify which part is alleged to be in violation, whether the violation is compoundable and which law the authority has relied on. An old tax receipt or electricity bill does not, by itself, prove that the construction was sanctioned. If an urgent stay is needed, it is important to approach the competent forum in time.

What Should You Do?

  1. Immediately compare the notice with the sanctioned plan and property documents.
  2. Submit a factual reply and request a hearing within the prescribed time.
  3. Check the time limits for any available appeal or interim relief against a final order or imminent action.

What Documents Should You Keep?

Keep the notice, proof of service, sanctioned plan, permissions, replies, and hearing and final orders.

Hypothetical Example

Only one part of a building was alleged to be unauthorised, but the owner submitted a tax bill for the entire house. The specific deviation and its comparison with the approved plan would be more relevant; payment of general property tax does not fully answer the dispute.

Does Every Demolition Come with Fifteen Days’ Protection Without Exception?

No. The exceptions in the court’s directions must be read together with the applicable local law.
