Telecom providers have prescribed reporting channels for unsolicited commercial communications. It is important to distinguish a complaint from a general spam report and to understand the current reporting window.

Understand the Law and Procedure

Customer preferences, previously given consent and the service category of a message may be relevant. Not every call from an unknown number is telemarketing, and not every promotional message is supported by valid consent. Under TRAI’s framework, service providers’ channels, the DND app and prescribed short-code arrangements may be used. If a fraud call causes financial loss, separate bank/cyber reporting may be necessary in addition to a telecom complaint. Emailing TRAI is not a substitute for adjudication of every individual complaint. Providing accurate sender details through the official process and within the prescribed time can assist enforcement.

In Detail: What Could Affect the Outcome?

Note the caller’s number, the time of the call and the subject of the promotion. Keep the full text and header of any SMS. Do not assume that you need to provide an OTP or identity details to an unknown caller to verify a complaint. If you gave consent for a service, keep a record of its withdrawal. The complaint acknowledgement and the provider’s response to its disposal can help you understand further escalation.

What Should You Do?

  1. Check your DND/preferences and the status of any relevant promotional consent.
  2. Provide the call/SMS details through your provider’s official reporting channel within the prescribed time.
  3. If there are signs of fraud or a loss, file a separate complaint with the relevant financial/cyber authority.

What Documents Should You Keep?

Keep call logs, SMS messages, consent-withdrawal records, the complaint number and the operator’s response.

Hypothetical Example

A person had consented to receive an insurance offer, later withdrew that consent, but continued to receive calls. The withdrawal record and the dates of subsequent calls make the complaint clearer than a report stating only “unknown number.”

Does Blocking a Number on Your Phone Also Count as a Formal Complaint?

No. Blocking is a personal protection measure; the prescribed complaint/reporting process for regulatory action is separate.
