Detailed analysis

Understanding law and procedure

Direct answer

Obtain the complete medical record and chronology before deciding whether harm resulted from a departure from an acceptable standard of care. A complication, unsuccessful treatment or death does not automatically prove negligence. Compensation, professional discipline and criminal prosecution serve different purposes and have different requirements. Filing in one forum does not automatically satisfy another forum’s deadline or evidentiary conditions.

What must the case explain?

Identify the duty of care, alleged breach, actual harm and causal connection. If monitoring was omitted, explain what monitoring was required, what the records show and how the omission relates to the harm. A later doctor preferring another treatment does not, by itself, prove the earlier treatment negligent.

Diagnosis, consent, surgery, nursing, medication, equipment, emergency response and discharge advice can raise different questions. A signed consent form does not excuse every lapse, but the treatment authorised and risks explained remain relevant evidence.

Preserve the clinical record

Request admission and case notes, consent forms, operation and anaesthesia notes, investigations, medication charts, nursing and vital-sign records, discharge or death summaries and bills. Referral, ambulance, follow-up and subsequent-hospital records may complete the sequence. Retain the dated request and acknowledgment, preserve originals and index working copies.

Create a timeline of symptoms, requests for attention, responses, tests and treatment. Avoid selective screenshots that omit important clinical context. An independent competent medical opinion can help assess the case, particularly for technical disputes. Do not assume that an identical expert certificate is a compulsory pre-filing requirement in every consumer complaint.

When is a consumer complaint appropriate?

Where the transaction and service fall within consumer law, a complaint may seek redress for deficiency and compensation. Paid treatment, insurance or employer-funded treatment, free-service arrangements and beneficiary status require separate assessment. Not every medical-service arrangement is identical. Any case-specific stay or later binding jurisdictional direction must also be considered.

Under the 2021 pecuniary-jurisdiction rules, consideration paid up to ₹50 lakh falls within the District Commission’s limit; above ₹50 lakh and up to ₹2 crore within the State Commission’s limit; and above ₹2 crore within the National Commission’s limit. Do not select the forum merely by demanding a larger compensation figure. Territorial jurisdiction and standing remain separate requirements.

Section 69 of the Consumer Protection Act generally prescribes two years from the cause of action. A delayed complaint requires the applicable sufficient-cause explanation. Discovery and continuing treatment need factual analysis; repeated reminders do not automatically restart a fresh two-year period. Check current e-Jagriti filing and local procedural requirements.

Civil and disciplinary proceedings differ

A civil damages suit has its own jurisdiction, limitation, valuation and court-fee questions. A complaint to the competent State Medical Council or professional regulator concerns misconduct and disciplinary responsibility. Discipline and compensation are not interchangeable outcomes. A notice issued on a professional complaint is not itself a final finding of negligence or an award of damages.

Criminal liability has a higher threshold

Jacob Mathew v. State of Punjab, decided on 5 August 2005, particularly official PDF pages 18–21, explains the higher or gross-negligence standard and safeguards concerning criminal prosecution of medical professionals. It should not be converted into one universal expert-opinion barrier for all consumer cases. The Supreme Court’s medical-negligence decision of 30 August 2017 also discusses the difference between civil and criminal standards.

For applicable post-1 July 2024 offences, Section 106(1) BNS concerns death caused by negligence. It contains a special maximum of two years and fine for the covered act of a registered medical practitioner performing a medical procedure. That is not an automatic section for every medical injury, health worker or treatment disagreement. Older events and other allegations require examination of the IPC or other applicable provisions.

Prepare a focused complaint

  1. Identify the parties, treatment dates, specific lapse and resulting harm.
  2. Index the records and provide page references.
  3. Connect allegations to evidence or competent opinion rather than presenting technical uncertainty as established fact.
  4. Support further treatment costs, loss of earnings, disability, dependency and other claimed losses.
  5. Establish forum, limitation, precise relief and the required affidavit or filing compliance.

In Kamineni Hospitals v. Peddi Narayana Swami, decided on 22 April 2025, 2025 INSC 527, the Supreme Court sustained the negligence finding on the records and evidence but separately adjusted the hospital’s operative compensation liability. Its amount is not a tariff for every later case. The loss and relief must be justified on the individual evidence.

Example

A patient deteriorates after surgery. The family alleges that repeated reports of deterioration were not acted upon for several hours. A useful assessment compares vital signs, contemporaneous communications, nursing and treatment records and competent medical evaluation. A death certificate or payment receipt alone does not establish the alleged lapse and causation.

Common questions

Is a legal notice useful?

A reasoned notice can help obtain records, clarification or settlement, but does not automatically suspend limitation. Check any forum-specific requirement.

Should allegations be published on social media?

Unverified accusations and disclosure of private patient information can create separate disputes. Preserve evidence and use a lawful complaint route first.

What should be done immediately?

Secure the complete file, dates, receipts and evidence of actual loss. Those records help determine the appropriate forum and viable remedy.
