Such a sign does not eliminate all responsibility for defective goods or misrepresentation. However, there is no universal right to return every purchase simply because the buyer changes their mind when there is no defect.
The condition of the goods, warranty, stated features and terms of purchase are relevant. Even for a cash purchase, the transaction can be established through available evidence. Not having an invoice may make a claim more difficult, but does not extinguish the claim in every circumstance.
What should you do now?
- Identify the problem and make a written request to the seller for repair, replacement or an appropriate refund.
- Gather proof of purchase and the warranty conditions.
- If you do not receive a response, consider the NCH and the appropriate consumer remedy.
Which documents should you keep?
Bill, payment entry, warranty, messages and photographs of the defect.
Do not make this mistake
Damaging goods before returning them or giving an incorrect purchase date is not an exercise of consumer rights.
A hypothetical example
One person wants to return a shirt solely because they do not like its colour; another person’s purchased machine does not work. It would not be correct to treat both as having the same unconditional refund claim. The distinction between a defect, the policy and representations is important.
Is a shop required to accept the return of every item that is in good condition?
No. For a change-of-mind return, the store policy and any specifically applicable rules are important.
