The new central framework places online money games, online social games and e-sports in separate legal categories. Simply describing a game as one of “skill” or “sports” does not bring a game involving stakes into a permitted category.
Understand the law and the process
The 2025 Act and the rules effective from May 2026 set out a framework for identifying the nature of an online game, regulatory processes and user complaints. It matters what the money paid in a game is for, what benefit the user expects, and how the prize or payout is determined. A subscription fee or an administrative fee for an actual competition is not the same as a stake placed to obtain a benefit in return for winning. Using a foreign website or cryptocurrency does not automatically exempt a user from Indian rules. A game’s classification will depend on its overall structure, not the language used in its advertising.
In detail: What factors could affect the outcome?
An old account, an influencer’s code or availability on an app store is not proof of legal permission. Users should check the operator’s identity, its declared classification and its complaint mechanism. Read the withdrawal and refund conditions before depositing new money. Submitting a written claim to the operator for money already stuck is a separate step; recovery of the loss is not guaranteed.
What should you do?
- In the terms, identify the conditions for deposits, stakes, subscriptions and prizes separately.
- Check the operator’s regulatory status and details of any official determination or registration.
- If a dispute arises, submit a grievance with the payment record; if there is fraud, use the relevant complaint channel.
Which documents should you keep?
Keep the game rules, deposit receipts, wallet statements, withdrawal messages and details of the operator.
Hypothetical example
Two apps offer the same quiz. One charges only a fixed subscription; the other requires users to stake money in every round and pays out winnings. The fact that both are quizzes does not mean they belong to the same legal category. The actual payment arrangement must be examined.
Can an app registered abroad always operate in India?
No. When providing services in India, the applicable laws and restrictions must be checked; foreign registration does not itself grant permission.
