Whether a recording is admissible in court is separate from whether making or publishing it is lawful. There is no simple rule in India that every recording is lawful.

Your relationship to the other person, your participation in the conversation, privacy, relevance and authenticity are important. In its 2025 decision in Vibhor Garg v. Neha, the Court considered the context of recordings in matrimonial proceedings; it did not grant open permission for everyone to spy on others or publish recordings. The requirements for electronic evidence must also be met.

What should you do now?

  1. Understand why the recording is necessary and what lawful alternatives are available.
  2. Preserve the original recording, the date and the device details.
  3. Before using it in court, check its admissibility and whether a certificate is required.

Which documents should you keep?

The original audio, device details, the complete transcript and the relevant case context.

Avoid this mistake

Hacking someone else’s account, installing spyware or making private audio go viral is not a general permission to gather evidence.

A hypothetical example

In a family dispute, the complete audio is available, but only a ten-second edited clip was shared. The original and its context may be important for court use. Public sharing may create a privacy dispute separate from questions about the evidence.

Is a short edited clip sufficient?

Its completeness and authenticity may be disputed; it is important to preserve the original.
