Is a Will Valid Without Registration?

Registration of a will is generally not mandatory. Its validity nevertheless depends on the applicable legal requirements, free choice, mental capacity and proper execution; registration alone does not prevent a challenge.

Registration of a will is generally not mandatory. Its validity nevertheless depends on the applicable legal requirements, free choice, mental capacity and proper execution.

The general rules for unprivileged wills under Section 63 of the Indian Succession Act include the testator’s signature and attestation by at least two witnesses. These rules do not apply mechanically to all personal laws and special wills. A registered will may also be challenged on grounds of fraud or pressure.

What should you do now?

  1. Clearly describe only your legally owned property and the beneficiaries.
  2. Use independent witnesses and comply with the applicable execution requirements.
  3. Keep the original will safe and make any later changes clearly.

Which documents should you keep?

Property details, beneficiaries’ identities, witnesses’ details and any earlier wills.

Avoid this mistake

Do not treat a notary’s seal or registration as proof that cures every other legal deficiency.

A hypothetical example

A will is registered, but its execution or the pressure under which it was made is disputed. Registration may be an important circumstance, but the court may still examine other essential elements. A challenge is not necessarily defeated merely because the will bears a seal.

Can a will be changed later?

A person with legal capacity may make a new will or change an existing one in accordance with the applicable law; a clear date and proper procedure are important.
