Direct answer
There is no single limitation period for every criminal appeal. Identify the appellant, the challenged decision and the appellate forum first. For ordinary appeals against other sentences or orders under Article 115 of the Limitation Act, the usual period is sixty days to the High Court and thirty days to another court. Death-sentence appeals, acquittal appeals and proceedings under special legislation require their own analysis.
Establish the right and route of appeal
Section 415 BNSS provides for conviction appeals in cases governed by the new procedure; Section 374 CrPC may remain relevant to saved proceedings. The correct forum depends on the trial court and statutory framework, not simply whether the sentence sounds serious. Guilty pleas and petty cases can also limit appellate rights.
A victim’s appeal, a State appeal against acquittal and a complainant’s special-leave route are not interchangeable with an accused’s conviction appeal. Special statutes can prescribe a distinct court, deadline or restriction on condonation. A special leave petition to the Supreme Court is another distinct remedy. Selecting the right proceeding is the first step in calculating time.
Build a dated limitation chart
Record the judgment date, sentence-order date, copy-application date, when the copy became ready or available, collection date and proposed filing date. Section 12 of the Limitation Act can exclude time requisite for obtaining the relevant copy in an eligible appeal. It does not ordinarily erase the time already spent before applying for the copy.
Where judgment and sentence were pronounced separately, examine the actual appealable order. If the last day falls on a court holiday, Section 4 and the applicable filing rules may matter. Have the complete calculation checked rather than assuming that limitation always starts when the copy reaches your hands.
How to explain a late appeal
Where Section 5 is available, request condonation of delay on sufficient cause. Condonation is not automatic, but delay does not invariably defeat the appeal either. Explain the obstacle with dates and supporting material. A general statement that the appellant was unaware of the law or that counsel was busy may not adequately explain a substantial interval.
Set out the computed delay, the period during which the obstacle operated and the steps taken after it ended. Hospital records, custody-related correspondence, copy applications and communications about obtaining the file can be useful. The chronology should be truthful and internally consistent. Do not omit an earlier proceeding or change a date simply to make the calculation appear convenient.
What should the appeal file contain?
- Required copies of the judgment and sentence or other challenged order.
- A concise factual statement, specific grounds and the relief sought.
- The limitation chart and, where necessary, a supported condonation application and affidavit.
- Accurate information about custody, earlier bail and any surrender or appearance requirement.
- Identifiable references to important trial evidence and documents required by local filing rules.
Useful grounds explain the legal or evidentiary error: which finding misreads a witness, which statutory safeguard was overlooked or why the sentence warrants interference. Repeating that the decision is unjust does not identify an appellate error. Additional evidence at the appellate stage also requires the applicable legal basis; it is not admitted simply because the appellant now wishes to improve the record.
Filing an appeal does not suspend the sentence
Apply separately for appropriate interim relief. Section 430 BNSS or Section 389 CrPC, depending on the governing procedure, concerns suspension of sentence and bail. Suspension of sentence, stay of conviction and acquittal are legally different outcomes. Employment, electoral or other statutory consequences may continue unless the precise relief required has been granted.
An imprisoned person can seek legal-services assistance through the relevant legal services authority or prison legal-aid system. Such assistance should be sought promptly while preserving the appellate deadline. Do not assume that a pending request for help itself stops limitation.
Example
A Magistrate convicts a person whose appeal lies to the Sessions Court. The person applies for a certified copy twenty days later. It is unsafe to start an entirely new thirty-day period from eventual delivery of the copy. The order date, twenty elapsed days, time properly excludable for the copy and filing date must be reconciled. If the result is delay, explain it separately with evidence.
Common questions
Does every appeal filed after 1 July 2024 necessarily use BNSS?
No simple date-only assumption is safe. Section 531 savings, the procedural history and governing decisions must be examined to determine the applicable code.
Is revision a substitute for appeal?
Revision has a different supervisory function and scope. Choosing the wrong remedy can create maintainability and limitation problems.
How quickly will the appeal or bail request be decided?
Registry compliance, records, notice, custody and listing affect the schedule. An article cannot guarantee immediate admission, bail or final disposal.
