Section 45 adds a statutory test
PMLA section 45 requires an opportunity for the Public Prosecutor to oppose and, where opposed, assessment of reasonable grounds for believing the accused is not guilty and unlikely to commit an offence on bail. This operates alongside the relevant ordinary considerations. Neither a large amount nor the economic nature of the allegation produces an automatic answer for every case. [1]
The proviso permits Special Court consideration for specified categories, including a person below sixteen, a woman, a sick or infirm person and the stated accusation involving laundering less than one crore rupees. These categories do not guarantee release. Check the precise statutory wording, combined allegation and actual circumstances. An old pre-amendment report cannot establish that the current twin conditions do not operate.
Explain individual involvement and custody grounds
Examine the alleged proceeds of crime, participation, banking trail and relied material. Existence of a scheduled offence and the separate money-laundering ingredients raise distinct questions. Match arrest legality, document supply, merits bail and prolonged custody with the correct prayer. Understand the prosecution complaint's procedural setting instead of treating it uncritically as an ordinary police charge sheet.
For example, account credits require records explaining source, control and alleged involvement. Inventing a transaction explanation is not an acceptable response.
A medical-proviso request needs current health evidence. Counsel should assess current decisions and the particular prosecution material before selecting relief. Amount, occupation or status alone cannot responsibly predict a guaranteed bail result.
Assess any proviso claim through its precise wording and supporting facts. Eligibility for consideration is different from an unconditional entitlement to release.
Check the separate requirements of special legislation
Some prosecutions involve additional statutory bail restrictions beyond the general procedural rules. Do not treat all non-bailable offences as a single category. Examine the particular enactment, ingredients of the allegation, prosecution material and the role of the competent Special Court. [2]
An assertion of innocence does not by itself answer an additional statutory test. Identify the fact supporting the allegation and the records supporting or contradicting it. A bail request does not require public disclosure of a legally protected identity. Maintain the applicable confidentiality requirements in copies and public discussion as well as in the presentation before the court.
Use financial and digital records accurately
Preserve bank statements, transaction references, account-operation details and original communications. Receipt of money, use of funds and knowing participation in an offence are different factual issues. Explain the applicant's individual role and respond to the prosecution material. Account-freezing relief is separate from release of the person.
Repayment or a settlement proposal does not automatically terminate every criminal accusation. If a deposit is directed, understand its wording and legal basis through counsel. Deleting evidence, informally transferring account operation or creating false bank records is inappropriate. Obtain authorised material from the relevant institution or through the competent authority instead.
Build a reliable case chronology
Keep the FIR, arrest and first remand dates, prison details, alleged sections and earlier orders together. Prepare a short chronology distinguishing allegations, prosecution assertions and facts supported by records. An incorrect date or incomplete crime number can obstruct an otherwise urgent request.
Tell counsel about previous cases, earlier bail applications and outstanding warrants. Preserve original digital files and available acknowledgments. Annex documents that explain the relevant issue rather than collecting unrelated private information. After each hearing, record the next date and the directions actually made. A clear file helps counsel identify both the appropriate remedy and the material the court still needs.
Frame the prolonged-custody argument accurately
Consider the custody period alongside the maximum punishment, accusations and remaining trial. Statutory eligibility under BNSS section 479 differs from the constitutional question of an effective speedy trial under Article 21. Failure of one route does not necessarily extinguish every other statutory or constitutional remedy. [3] [4]
Explain how attendance and witness safety can be secured after release. Support an assertion of an uncertain trial with the available orders. Counting another accused's months in custody cannot determine the outcome of this application. Each ground requires its own legal assessment, including the effect of any applicable special enactment.
