Direct answer
A government employee holding a transferable post ordinarily has no unlimited right to remain at a chosen station. Judicial protection may be considered where a transfer violates a mandatory statutory provision, is issued without authority or is vitiated by properly supported mala fides. Personal hardship can justify a departmental request, but does not automatically establish a right to a court stay.
Policy is not always a statutory entitlement
Read the exact provision relied on. Administrative transfer policies guide decision-making; binding statutory service rules can have a different legal force. Expressions such as “as far as possible”, a normal tenure and an absolute prohibition do not mean the same thing. Spouse-posting, medical, retirement and school-session provisions must be read with their qualifications and exceptions.
In Union of India v. S.L. Abbas, decided on 27 April 1993, the Supreme Court explained the limited scope for interference and distinguished administrative guidelines from an enforceable statutory right. This does not make every representation futile: the authority should consider a genuine request alongside administrative requirements.
Identify a legally reviewable defect
Check the issuing authority’s power and delegation, the applicable rule and the transfer’s actual effect. If a punitive or unrelated purpose is alleged, identify the supporting events and documents. Repeated transfers or differential treatment may be relevant circumstances, but a bare assertion of unfairness is not a complete legal ground.
Allegations of personal mala fides require particulars and appropriate impleadment of the person concerned. The Supreme Court’s 13 March 2024 transfer judgment discusses the significance of missing pleadings, non-joinder and failure to establish a statutory violation. A recommendation by an elected representative does not, by itself, make every transfer unlawful; the decision and its factual foundation must be examined.
Prepare a useful hardship representation
- Identify the order, its date and the existing and proposed stations.
- Quote the relevant policy clause accurately and explain why it covers your category.
- Attach proportionate evidence of medical needs, disability, dependent care, spouse posting or another relevant difficulty.
- Suggest a practical alternative station or limited deferment where appropriate.
- Obtain acknowledgment and state the urgent relief requested.
A medical diagnosis alone may not explain why treatment continuity requires a particular location. Relevant treatment records and practical details are more useful. Avoid unnecessary disclosure of sensitive family information; court filings may require suitable redaction under local rules. A restrained, supported representation is stronger than a collection of unverified accusations.
Choose the correct forum
Where the employee and subject fall within the Administrative Tribunals Act, the CAT’s original jurisdiction and departmental-remedy requirements need examination. For an ordinary State employee, Article 226 jurisdiction of the appropriate High Court or an applicable tribunal framework may be relevant. The correct forum is not identical for every public employee.
Armed Forces personnel, CAPFs, public-sector bank employees and private employees can be governed by different arrangements. The AFT is not a general forum for all employment transfers. Identify the employing entity and service category before selecting a court.
Filing does not suspend the duty to comply
A representation, case number or order issuing notice is not necessarily a stay. Obtain and read an actual departmental deferment or competent court’s operative protection. Refusing to join or disregarding relieving without protection can have service consequences. Joining under protest, seeking an extension or another course must be assessed on the individual record; a generic article cannot safely advise everyone to remain absent.
An urgent OA or writ should place the transfer order, governing provision, service chronology, representations and necessary parties before the forum. The interim application should identify the joining or relieving date and explain the immediate prejudice. Do not conceal an earlier transfer challenge or adverse order.
What relief can realistically be sought?
Depending on the case, a court may interfere with the order, grant limited protection or direct a reasoned decision on a representation. A direction to consider the representation is not the same as cancelling the transfer. Courts do not ordinarily replace the administration’s personnel-management assessment with their own posting plan.
Timing and an example
Act promptly when a joining date is near. Unexplained delay can matter in writ jurisdiction; CAT limitation and statutory procedural requirements are separate issues. Repeated reminders do not necessarily revive an old grievance. Fees and filing requirements depend on the forum and work involved.
Suppose an employee’s child has imminent examinations and a policy generally favours avoiding disruption. That supports a documented request for accommodation. A transfer made by an authority lacking power under a binding rule presents a different legal question. Calling both situations simply “policy violation” obscures the distinction.
Common questions
Does transfer before completing three years guarantee a stay?
No. Check the policy’s wording, exceptions, administrative context and statutory status.
May I remain at the old station after a direction to consider my request?
Only where the actual order or a departmental decision provides that protection. Read its operative terms.
What should be assembled first?
The service history, exact rule or policy, supporting hardship documents and compliance deadline. These help distinguish a representation from a legally maintainable challenge.
