Detailed analysis

Understanding law and procedure

Is a second FIR for the same incident illegal? Not necessarily. The key distinction is whether the second report merely repeats the same transaction or concerns a distinct occurrence or a genuine counter-version.

Compare the two FIRs systematically: time, location, participants, complainants, alleged acts and continuity of events. Identify what the first investigation already covers. A counter-complaint by the opposite side cannot automatically be rejected merely because another report was registered earlier.

Depending on the facts, place a documented objection before the investigating authority and assess appropriate proceedings, including the High Court’s inherent jurisdiction under BNSS section 528. Arrest-related relief is a separate issue.

Documents: certified FIR copies, complaint history, station records, medical records, videos and event chronology. Takeaway: The legal issue is substantive duplication, not the serial number of the FIR.
